The procedural indemnity amounts are indexed on the basis of the consumer price index (base 2004). Indexation does not take place automatically every month, but only when the index has risen or fallen by at least 10 points compared to the time of the previous indexation. Historically, the procedural indemnity rate has been indexed several times a year in periods of high inflation (such as 2021–2023), and only occasionally in more stable times.

The most recent indexation took place on 1 March 2025, following the February 2025 index (166.05 points, base 2004) exceeding the threshold of 165.78. This was also the first application of the new calculation formula introduced by the Royal Decree of 16 May 2024. The next indexation will take place when the index reaches or exceeds 175.78.
